TRADE MARKS REGISTRATION IN DOMINICA
In Dominica, trade marks registration is done under the Trade Marks Act. This Act was passed in 1887 and although a new law was enacted in 1999 it is yet to be brought into effect.
The requirements for registration under the current Act are as follows:
- Authorization of Agent
- Statement Form
- Declaration Form
- 14 copies of the representation, if the mark is represented by a logo, label, print, design or device
- Disclaimer is used only when words are in common use.
Trade marks registered in the United Kingdom may also be registered in Dominica under the Registration of United Kingdom Trade Mark Act.
The requirements for registration under this Act are as follows:
- Authorisation of Agent
- UK Certificate of Registration (sealed)
- 14 copies of the representation, if the mark is represented by a logo, label, print, design or device

PATENT REGISTRATION IN DOMINICA
Patent registration is done under the Patents Act. The requirements for registration under this Act are as follows:
- Schedule
- Memorandum
- Form of Provisional Specification
- Form of Complete Specification
Patents which are registered in the United Kingdom may be registered under the Registration of United Kingdom Patents Act. The requirements for registration under this Act are as follows:
- Affidavit or Statutory Declaration
- Certified copy of the specification(s) (including drawings if any) of the UK patent
- Certificate of the Comptroller of General of the UK Patents office giving full particulars of the issue of the patent on the specification(s)
In 1999, a new Patent Act was passed to give effect to the PCT of which Dominica is a signatory. Unfortunately, this Act is yet to be brought into effect. The Registrar of Patents have however been receiving national phase applications under the PCT.
